The U.S. Court of Appeals for the Eighth Circuit reversed a district court’s dismissal of a suit brought by the Missouri Broadcasters Association (MBA) claiming that a Missouri statute and two regulations restricting alcohol advertising are unconstitutional under the First Amendment. MBA claimed that these restrictive provisions “prevent consumers from receiving truthful information in advertising. Specifically, although retailers can offer price discounts and promotions on alcoholic beverages, these laws keep citizens from learning about those discounts in advance, through radio, television, and newspaper ads.”
