Production Cap Increased in Montana

Signed by the Governor, H.B. 541 changes the definition of “small brewery” to allow annual production up to 60,000 barrels (from the current 10,000) and would include the production of all affiliated companies and beer purchased from any other beer producer to be sold by the brewery. The bill also restricts breweries to no more than three taprooms each and no more than 2,000 barrels of on premises taproom sales per brewery. Finally, it increases the tax on breweries producing between 10,000 and 20,000 barrels annually.
